After what looked like forever enduring court trails for almost a year, a 34-year-old Gwembe teacher was finally acquitted of defilement.

This is in a matter in which Chapasi Simukoko was accused of defilling a 3-year-old toddler.

But after hearing the circumstances surrounding the allegations and facts brought before the court, Magistrate Mulalelo who presided over the matter acquitted Simukoko of the charge.

Simukoko was represented by defence lawyer Kelvin Zimba of Messrs Mosha and Associates.

Mr Zimba explained that the case that was slapped on his client lacked collaborative evidence and statements by the key witnesses were not consistent.

Mr Zimba said the medical report issued against his client lacked key particulars of the victim’s gynaecological state at the time of reporting the offence.

“The medical report lacked particulars about the victim’s hymen and weather it was tempered with at the time or not, also the case lacked collaborative evidence and statements from key witnesses,” he said.

The lawyer felt that justice had been served as possibilities of his client being framed were very high.

Particulars of the offence are that Simukoko of Gwembe District on December 12, last year took the victim to his home for a sleepover after she insisted to come with him to his house. It was heard that the accused had been invited for lunch by the mother to the girl. As family friends, their children also related well as friends.

It was alleged that upon returning home on December 13, 2022, the victim’s mother discovered bruises on the toddlers private parts and she subsequently reported the matter to police.

But after due process of trail, Magistrate Mulalelo found that the state had failed to prove their case. He found Simukoko innocent and accordingly set him free to walk to his freedom.
