DICKSON JERE URGES DOCUMENTATION IN LAND DEALS

Renowned lawyer Dickson Jere has appealed to the public to always ensure that land transactions are properly documented.

Jere, who previously served as Special Assistant to Fourth Republican President Rupiah Banda, emphasised that oral agreements are insufficient when dealing with property.

He referenced the case of Kunkuta v Chibangula & Another – Appeal No. 8/2019, in which the Supreme Court dismissed an appeal due to lack of written evidence.

The lawyer explained that courts demand documentary proof to support claims of ownership in disputes involving land.

He observed that without receipts or signed instruments, even credible witnesses cannot secure a favourable ruling.

Jere underlined that a trust concerning land must be created in writing, unlike personal property which may be established orally.
