BOWMAN Lusambo has submitted that a Deoxyribonucleic Acid (DNA) test will be the only sure way to determine the paternity of Mercy Cowham’s four children.
Lusambo, who is former Lusaka Province minister, sued Mercy Cowham in the Lusaka High Court over her allegations that he is the father to her four children.
Lusambo seeks an order that a DNA test be conducted on the four children to ascertain their parternity.
The plaintiff is demanding damages for libel from Mercy and an order that she retracts and apologises to him over her statements in question, costs and any other
reliefs the court might deem fit.
However, Mercy in her defence, submitted that she was in a relationship with Lusambo which resulted in her having four children for him.
But in an affidavit in support of summons for paternity filed in court, Lusambo stated that he does not know Mercy at all.
“I have never been engaged in any form of sexual activity with the defendant, whatsoever. I believe that a DNA test will be the only sure way to determine the paternity of the defendant’s four children,” he said.
Lusambo stated that Mercy would not be prejudiced in any way but conversely, the interests of justice will be served.
In his skeleton arguments, Lusambo stated that he is a responsible citizen and a man of honour who is highly respected in society.
“The defendant’s allegations are incorrect and untrue. We pray that the court grants our application for an order for DNA test to be done in the interest of justice,” stated Lusambo.
