COLLECTIVE gasps of shock echoed through the Ndola Local Court on Monday as a heartbroken man recounted how his naked wife and her lover beat the living day out of him when he caught them committing adultery in his matrimonial home.
David Simbeye told the court presided over by magistrate Elizabeth Banda that on June 27, 2024, he walked in his matrimonial home and found his wife Mercy Phiri who is a soldier with nothing her engaging in “bedroom combat drills” with her fellow soldier and workmate Augustine Muziya.
Enraged with what he had seen, Simbeye decided to teach his cheating wife a physical lesson or two on the sanctity of the matrimonial bed but what followed was a beating he will never forget in his life.
Without the care to dress up and cover their shame, Simbeye’s wife who is reported to have recently returned from a peace keeping mission in Central African Republic, teamed up with her boyfriend and beat up her poor civilian husband as if he were an M23 rebel.
When Simbeye ran outside to serve himself from the painful beating, the naked duo followed him outside with their biological tools of enjoyment dangling much to the shock of neighbours who came to his rescue.
From the ordeal, Simbeye sustained painful injuries for which he was briefly admitted to the local clinic.
After recovering, Simbeye sued Augustine Muziya in the Ndola Local Court for committing adultery with his wife.
Testifying in the case, Simbeye said Muziya, a widower had taken advantage of the differences he had been having with his wife to start an affair.
Simbeye said he grew suspicious when his wife began exhibiting strange behaviour coupled with suspicious phone calls, and the whispered warnings from neighbors.
He also said his son informed him that Mercy had been receiving calls from a man who had been visiting her in the bedroom when he was away.
But on the fateful of the beating, Simbeye walked on his wife and confirmed all his suspicions.
“I went straight to the bedroom to my surprise I found my wife with Muziya they were both naked.
“I decided not do anything to the man but started beating my wife that is when Muziya started beating me and my wife joined while they were naked.
“We went outside the bedroom thats when he got a pot and started hitting me with it,” Simbeye testified.
In his defence,Muziya denied having sex with Mercy and assaulting Simbeye stating that he was found in the sitting not in the bedroom.
He told the court that it was in fact Mercy who Phiri who proposed an affair with him when they met in Bwasombe and that she told him that she was not married but had two children.
But contrary to his statement, Mervy told the court that she met Muziya at work and told him that she was married but having marital disputes with her husband.
She admitted that the two where on separation but that her husband was providing for her and that they used to enjoy conjugal rights.
And a witness Luka Simwelu testified that on the material day, he saw Muziya hitting Simbeye with a pot while he was just wearing a boxer and Mercy who was only wearing a breastholder and bum short was separating the two.
In passing judgement Magistrate Banda said there was overwhelming evidence that Muziya committed adultery with Phiri.
She ordered Muziya to pay Simbeye K10,000 in installment of K 1,000 every month.
