Chibolya Woman Pleads Guilty to Unauthorized Child Care Facility

A 36-year-old woman from Chibolya has pleaded guilty to establishing a child care facility without authorization from the Department of Social Welfare.

In this matter, Josephine Hamawa is facing one count of prohibition of establishing a child care facility without approval.

Hamawa, who appeared before Lusaka Principal Resident Magistrate Idah Phiri, admitted to setting up the facility without the required clearance. She told the court that the facility is registered with the Patent and Companies Registration Agency (PACRA), but said she was unaware of the need for social welfare approval.

Magistrate Phiri, however, stated that ignorance is not justification for establishing such a facility without authority.

The matter has since been adjourned to April 9, 2026, for the reading of facts and possible sentencing. This follows an application by State Prosecutor Mukwashi Banda to allow the state to present detailed written facts to the court.
