CHIEF MUCHINDA KANKOMBA WELALA III REINSTATED

The High Court of Zambia has reinstated Senior Chief Muchinda Kankomba Welala III to the throne of the Muchinda Chiefdom in Serenje District, Central Province, following a Consent Settlement Judgment delivered under civil jurisdiction at the District Registry in Kabwe.

The case, registered as 2025/HB/046, involved the Plaintiff, Samson Mukasano, and the First Defendant, Kunda Chisenga, with the Attorney General of the Republic of Zambia named as the Second Defendant.

The judgment was officially recorded on 6th January 2025.

According to the court record, the First Defendant, Kunda Chisenga, admitted to his inability to properly administer the affairs of the Muchinda Chiefdom, citing ignorance and illiteracy, which had led to others taking advantage of him.

This admission formed the basis of a negotiated settlement between the parties, reached in consultation with the Muchinda Royal Family.

As part of the court-sanctioned agreement, Kunda Chisenga is to continue as Senior Chief Muchinda.

However, Samson Mukasano, recognised as Senior Chief Muchinda Kankomba Welala III, will assume a supervisory role over the chiefdom through his chairmanship of the Muchinda Royal Establishment Committee and Council of Elders.

The judgment further mandates the re-establishment of the Muchinda Royal Establishment Trust, which will be exclusively responsible for overseeing all commercial, mining, and investment activities within the chiefdom.

The Trust is also tasked with addressing any grievances or losses suffered by individuals, companies, or third parties due to prior mismanagement.

In addition, the reconstituted Royal Establishment Committee will include all Chilolos (senior traditional advisors) from across the chiefdom.

Their collective mandate is to oversee and manage traditional affairs in accordance with customary law and the guidance of the supervisory structure.

To ensure legal compliance and prevent further mismanagement, the law firm Marshall Chambers has been appointed by mutual consent to administer the Consent Judgment.

The firm will supervise all decisions and operations of both the Muchinda Royal Establishment Committee and the Trust.
