The full bench of the Constitutional Court has dismissed a renewed application for a Conservatory Order by the Law Association of Zambia-LAZ, Oasis Forum and others to halt the proceedings of the Constitution Amendment Bill Number 7 of 2025.
The court has dismissed the application on grounds it has been overtaken by events.
Delivering the ruling, Constitutional Court Judge JUDY MULONGOTI noted that there is nothing to conserve against the Constitution Amendment Bill Number 7 of 2025 as the petitioners have moved the court too late.
Judge MULONGOTI underlined that the Technical Committee on Amendments to the Constitution has already concluded its work and presented the report to President HAKAINDE HICHILEMA.
Other judges on the panel were Constitutional Court President MARGARET MUNALULA, Deputy Constitutional Court President ARNOLD SHILIMI, Judge MARTIN MUSALUKE and Judge MUDFORD MWANDENGA.
The Constitutional Court verdict comes after the reservation of a ruling yesterday, following the hearing of submissions from the State and LUSAKA Lawyer LINDA KASONDE who is the petitioners’ lawyers.
Tendering his submissions Attorney General MULILO KABESHA asked the Constitutional Court to dismiss the application for the Conservatory Order against the Constitution Amendment Bill Number 7 of 2025.
Mr. KABESHA based his argument on predictions that the main matter to halt the Constitution Amendment Bill Number 7 of 2025 has no prospects of success.
