The Anti Corruption Commission senior investigation officer today told the court that the commission saw it unnecessary to issue summons to a Mr Van Blake who sold Mr and Mrs Kampyongo bare land located in Eureka.

Speaking, during cross examination by defense lawyer Mr Leon Lemba of Mulungushi Chambers, the ACC officer stated that during investigations the commission had challenges meeting with the seller Mr Blake but only managed to meet with an assistant and during this meeting the commission obtained a copy of the land sale agreement which gave details of the cost of the land and how much has been paid.
A further review of the witnesses testimony, the defence asked why this said copy of the agreement was not tendered in as evidence to the benefit of the case as it would have put to rest the conflicting testimony on how much money the Kampyongo’s have paid so far.

Witness: yes we were given a copy of a transaction that took place where Mr And Mrs Kampyongo and Mr Van Blake
Defense Lawyer: Where is that agreement?
Witness: the document was not tendered in and it’s in the our custody
Mr Lemba further stated that the said agreement details how much the land costs and how much the accused have paid which according to the witness on stand today said a sum of $1400 has been paid.
And, the witness was reminded that according to the testimony of her co-investigator the court was told that the accused have paid a sum of $140,000.
Mr Lemba pointed out to the witness that the court has two conflicting amounts as to how much has been paid and if the said document was brought before court it would have put to rest the conflicting statements from two Officer from the same institution. He further questioned why the document was not submitted before court and why summons were not issued.
“If this was a copy witness why then didn’t you issue summons to have Mr Van Blake or the law firm to appear before this court and testify to your testimony”
The witness said because the document was a copy and not original and it was not necessary to issue the summons to the seller or the representing law firm.
To conclude questions on the agreement between Mr Van Blake and Mr and Mrs Kampyongo, the magistrate had to caution the witness to follow the rules as an investigations officer and answer the questions as they are put to her.
