ACC wants all of Faith Musonda’s ‘dirty’ property grabbed

THE Anti Corruption Commission has moved a motion before the Economic and Financial Crimes Court to have properties belonging to former ZNBC journalist Faith Musonda grabbed on reasons that they were illegally obtained.

According to an originating notice of motion for an application for a non-conviction based forfeiture order of tainted property the Commission wants Musonda’s illegally gotten wealth to be snatched without prosecuting her.

The application has been made pursuant to Order 30 Rules 15 and 17 of the High Court Rules as read together with Section 29 and 31 of the forfeiture of proceeds of crime Act no. 19 of 2020 of the Zambian laws.
The Commission has cited Musonda and her companies Sela property investment limited, Convent Broadcasting company and Life Television Limited as interested parties in the matter.

Among the properties to be seized by the graft fighting body are a house in Kingsland City. farm in Chisamba, business premises, Money in her Bank accounts and farm machinery.

The properties that have been seized and earmarked for forfeiture are ; Plot no. LUSAK/LN_24982/3 in Kingsland City, plot no. F/1504/A in Chisamba, plot no. F/378a/11 in Ibex Hill, Bank of Zambia Government bonds issue no.01/2021/BA, Treasury bills issue no.11/2021TBs, Madison Finance Fixed term deposits unit no. 1140446 and assorted jewels.

Others are a Tafe tractor 7515 75HP-unregistered, plough disc BD mounted AF3, Harrow Disc BD GHO-R mounted 16, planter BD PLB-4 mounted row, sprayer Boom Jacto(M) condor M12, Trailer 5TN steel deck and a Toyota Allion registration no.72M.
In an Affidavit in support of motion sworn by Furguson Kombe an investigations officer at the Anti-graft fighting body, on November 5, 2021, the Commission received a complaint from an anonymous person alleging that Musonda was in possession of property suspected of being proceeds of crime among them a house in Kingsland City which was purchased at US$180, 000.
The complainant alleged that other properties were hidden in the name of her friend Chimuka and Miyanda Mulambo a business associate.

Kombe said he instituted investigations and established that the house in Kingsland City was purchased at US$185, 000 and Faith paid US$144, 500 towards the purchase price. The farm in Chisamba was purchased at K4, 600, 000 in full.

He said Musonda’s business premises in Ibex Hill was purchased at K170, 000 from Sam Mulozi.

Kombe stated that a search at Patents and Companies Registration Agency (PACRA) revealed that Musonda is neither a director nor shareholder in Life TV but, correspondence from the Independent Broadcasting Authority (IBA) shows that she was the station manager.

He said the managing director at Life TV a Mr Malekano indicated that Musonda is the owner of the company.
The officer indicated that a valuation of the property revealed that it is worth K3, 516, 000.

Kombe said Musonda had government bonds at Bank of Zambia worth K3, 140, 000 which were issued to her for 10 years and her account at the Nation’s Central Bank also had Treasury bills worth K1, 100, 000.
“A number of suspicious cash deposits were made into account no. 62482557322 FNB, the aggregate of which were used for the purchase of a facility refered to as fixed term deposit which was to mature on August 30, 2022 worth K1, 219, 110,” Kombe said.

He indicated that during a search at her mansion in new Kasama jewels valued at US$5000- US$5500 were siezed.

The investigations officer said the farming equipment purchased from Saro Agro Equipment limited was valued at US$54, 844. 53. and was paid for in cash.

Kombe stated that during interrogations on the source of income Musonda said she was employed by ZNBC and Zambia Development Agency and had net earnings worth K825, 977 and K587, 820. 02 from January 2013 to 2020 which was cumulative to K1, 413, 797.02

“My investigations also revealed that Musonda is currently employed at Export Trading Group and has been drawing a salary from January 2020 to December 2021 and the net earnings for that period is K720, 000,” He explained.

Kombe said a search at PACRA revealed that Musonda is either a shareholder or director in Convenant Broadcasting, Rainbow Promise Academy, Gold Ore Company limited, Sela Property investment, Muntanyalwa investments, Clear Icon Media Consultants, Spick and Span Laurommat services and Ock Investment limited.
He stated that Vintage remitted requisite taxes at ZRA but was not submitting tax returns.

He further stated that Musonda had a Dollar account with Indo Zambia Bank no. 0142030002052 and according to the statements the account had a credit turn over of K3, 806, 949. 54 through cash deposits.
“There were suspicious transactions on the FNB account belonging to OCK investments and some money would be sent to Musonda’s personal account with Madison Finance Limited,” said Musonda.

“From the foregoing disproportions in official emoluments and values of property owned by Musonda I had reasonable grounds for suspecting that the properties could be proceeds of crime or were realized directly or indirectly from unlawful activity.”
