CHOMA MAN NARRATES HOW HE DELIBERATELY DEFILED NIECE

Without remorse, a 28-year-old man of Choma shocked the magistrates court when he proudly narrated how he deliberately defiled his seven-year-old niece to ‘punish’ her parents after he had an altercation with them.

In this case, Mwiinga Miyanda, a carpenter of Chandamali in Choma, is facing one count of defilement on a child under the age of 16.

Facts are that on February 15, 2024 in Choma district, Southern Province, Miyanda had unlawful carnal knowledge of a girl under the age of 16, who happens to be his brother’s daughter.

When the matter came up for plea before resident magistrate Ethel Phiri, Miyanda did not want to waste the court’s time as he willingly admitted committing the offence.

“Yes, I defiled her and I did it deliberately because I quarrelled with her parents. That was my way of getting at them. I was very much aware of the fact that she is underage,” Miyanda informed the court.

According to a statement of facts, on the material day, the victim, together with her younger sister aged five, went to Chandamali to see their father, who was working at a named shop, but they did not find him.

Miyanda took advantage of the situation and offered the girls to spend the night at his place since their father was not around. Based on the fact that Miyanda is their uncle, the girls agreed to go with him to his house, where he made them sleep on his bed.

While they were sleeping, Miyanda had carnal knowledge with the victim.
Based on his own admission of guilt, magistrate Phiri committed Miyanda to the High Court for sentencing.
